A Challenge to the Superintendent in the Texas Cheerleader Assault Case

My report on the Silsbee, Texas cheerleader assaulted by a high school sports hero and then extensively revictimized by the Hardin County community has occasioned a huge outpouring of concern over a court decision requiring the victim to pay the school’s attorneys’ fees of $45,000.  The assessment seems particularly outrageous in view of a court having fined the victim’s assailant only $2,500.  I have issued a challenge to Silsbee Schools Superintendent Richard Bain, the details of which are below.  We will be publishing a later update as to whether Superintendent Bain and the school’s attorneys have agreed to waive the $45,000 fee, or if they would prefer to have individuals from all over send in one cent each until the $45,000 fee is paid in full.

I believe everything in my report is factual.  A reporter for the Silsbee Bee had told me . .  prior to the publication of my article . . that he had seen the entire case file related to this matter and that if others were to see it, they would believe there were no grounds for criticizing Silsbee in any way.  I have now asked the Silsbee Bee to provide documentation showing that anything reported in my article is not factual.  If anything in it is not factual, I shall be publishing corrections.

Apart from that question, though, there has been a huge outpouring of concern for H.S. as regards the $45,000 fees she has been ordered to pay to the Silsbee Independent School District’s attorneys after she lost her free speech case against the school.

The reality is, you did attempt to compel the victim to cheer individually for a student, a Silsbee High School sports hero, who eventually pleaded guilty to assaulting her.  Her free speech case grew out of that incident.

I, personally feel, as do many other people, that you and your attorneys should waive the fee, and let the court know that you will not be requiring the assault victim to pay it.

If you will not do that, then I, along with assistants, will be organizing an effort to pay the fee by having the necessary number of people send one penny each.

So, here is what I wish to know from you now.  Will you and the Silsbee Independent School District be arranging things with the court such that the assault victim will not have to pay the $45,000 attorneys’ fee?  If not, then please provide the correct address to which people should send their one penny donations towards the $45,000.

    Let me know what that address is. Better, let us have a central address where all these pennies can be packed into canvas moneybags, and then dumped onto the Superintendant’s desk as the cameras roll.

      I think this is a great idea in that it will be a nuisance. I do see a problem in not making sure that no more than $45000 is sent. Do we really want to give these people additional money? A penny is annoying but you can still spend them.

        I have seen elsewhere that her attorney has set up a donation fund for her. I haven’t been to see it yet, but I’m assuming that further info is available on the facebook page mentioned above. Or at least it will be once I get confirmation that my info is legitimate.

        If we send the money to her (or to a fund that goes to her) then if more that $45,000 is raised, all well and good. Personally, I’m gonna send a helluva lot more than a penny. ;) She probably has other related costs, too.

          The pennies are to send a message to get them to waive the fees. In which case she will owe nothing. But she will still have to pay for her own attorney, so send the pennies to the superintendent and money for her to pay for her lawyers to the fund that her lawyers set up.

    Ironic how the most high profile politician in Alaska, being held accountable by her constituents, can use these efforts to keep her open and transparent can spin it into an excuse to quit her job for the greater good and amass a fortune in donations for a legal fund with no strings attached.

    This girl, for the record, was a victim of assault, but she is fined five times the amount charged of her attacker?

    I’m convinced that people who consider themselves as ‘conservative’ are so with compassion. Not only that, they are disgusted and even enraged by the weak. Until it happens to them or their own, with illness, assault, swindle, natural disaster and any other random act of God.

    If there is an effort to raise money for this girl, let it be known. Since she hasn’t recieved justice within her own community, better people in other parts of the country can make up for their poor and reprehensible behavior.

    I think it is much better to send our pennies in individual envelopes. That is 450 thousand envelopes to open I believe, check my math.

    And why is the “hero” not in jail? Last time I looked rape was a criminal not civil issue. I don’t think I will look it up though because what is being said on this page is making me sick enough.

    I think we should all start sending our pennies now so they get the message that Scott is not kidding. I am sending mine ASAP.

    The rapist was a football playa, thats why nothing happens to him. This needs to go to Racheal and the national news if they have the balls. Glenn beck, if you are for the people then stand up for this girl. Hannity, you fooking fraudulent slice of worm, you pretend you are for the people, stand up. No spin O’Leily? Where is Olbermann? Watching baseball? Who needs him.

    These people must be embarrassed nationally. Other wise this will go on.

    Count me in on this effort. I do not believe for one minute that a perpetrator of a crime should get off just because of a certain status, nor should a victim be penalized for asserting rights. It doesn’t matter to me if said perp is a high school sports star of the president of the United States.

    Unbelievable, truly unbelievable. I cannot imagine how that young woman is coping right now. As a parent I cannot imagine how hard it must be to sit by and watch your daughter hurt so badly and not be able to do something for her that would bring her justice. She will never ever be the same person now, nor will her family ever be the same.

    The bastard PROSECUTOR by saying that because the victim had been drinking and it would be difficult to prove she was raped, sent such an insidious message to every victim of rape and every rapist, if you have been drinking and say no, you are not being raped just shut up and spread ‘em and boys don’t worry you didn’t really rape her because it isn’t rape if she’s been drinking. No doesn’t mean no.

    Her body will heal but her mind and soul never will. I will begin mailing my pennies tomorrow certified and I will post this story on my FB and urge my friends to do the same.

    I have been in touch with the victim’s lawyer Larry Watts. I have received permission from the family to start crowd funding the 45K the family owes, with the hopes of raising over that in order to pay them back their own legal fees. I am in the process of getting a web page together.

    I still don’t understand why you kick the victim off the team instead of the criminal. If I was running that school he’d be kicked off the team because he represents the school and I wouldn’t want someone who pleaded guilty of sexual assault representing my school. But clearly they’d rather be known as the school that attacks victims and rewards criminals. Just disgusting!

    A bit late to the party, but my penny is sent. The text of my letter:

    Dear Mr. Bain:

    I was outraged several months ago to learn that a former cheerleader from the Silsbee School District was raped by a football player from that same school; threatened and harassed by students, teachers, and others who were not disciplined for their actions; and then dismissed from the cheerleading squad for refusing to cheer for the individual who assaulted and harmed her.

    I was dismayed to learn that she sued the school district for infringing her free speech, lost – and is now required to pay the school district’s attorney’s fees in the amount of $45,000. Please apply the enclosed penny toward those fees. In the event that the district makes the decision to waive those fees, or that you receive more than the $45,000.00 in donations, perhaps you can use it to buy yourself a soul.
