Judge Who Ruled Obama Violated the Constitution Has a History Of Right Wing Judicial Activism
The judge who ruled that Obama’s recess appointments violated the constitution is a Jesse Helms crony who overturned the convictions of Oliver and John Poindexter and sided with Bush on indefinite detentions.
Judge David Bryan Sentelle was first appointed to the bench by Ronald Reagan. Sentelle history of right wing activism from the bench was detailed by Will Stabley, “However, Sentelle was promoted to the United States Appeals Court shortly after, as a circuit court judge, he voted to overturn the convictions of Oliver North and John Poindexter – two key Reagan aides who had been found guilty in the Iran Contra scandal. This seeming tit for tat between Sentelle continued as he appointed Kenneth Starr to the role which Starr would go on to use in his overtly aggressive impeachment case against democrat Bill Clinton…Sentelle then went on to side with republican George W. Bush on the issue of indefinite detention without the right to trial, in a controversial ruling which saw even a fellow judge on his own panel dissenting against him.”
Sentelle has been described as a crony of Jesse Helms. He is also a member of the Federalist Society a group that describes itself and its role as, “Law schools and the legal profession are currently strongly dominated by a form of orthodox liberal ideology which advocates a centralized and uniform society. While some members of the academic community have dissented from these views, by and large they are taught simultaneously with (and indeed as if they were) the law. The Federalist Society for Law and Public Policy Studies is a group of conservatives and libertarians interested in the current state of the legal order. It is founded on the principles that the state exists to preserve freedom, that the separation of governmental powers is central to our Constitution, and that it is emphatically the province and duty of the judiciary to say what the law is, not what it should be. The Society seeks both to promote an awareness of these principles and to further their application through its activities.”
In short, David Sentelle is the poster boy for right wing judicial activism.
Mainstream media reports of the story have quoted Sentelle’s ruling, but have failed to mention his right wing activism from the bench. The fact that Sentelle would rule in favor of Bush’s unprecedented expansion of executive powers on indefinite detentions, but would the rule against the precedent of 150 years of recess appointments illustrates the partisan nation of Sentelle’s judicial philosophy.
The right wing is celebrating this ruling because it feeds into their delusion that Obama is an illegitimate president who has no respect for the constitution. The reality, which the media is happily ignoring, is that a right wing judicial hack ruled based on nothing more than partisan politics.
This ruling illustrates why the filibuster reform that was agreed to this week matters. President Obama has 33 judicial nominees that are being blocked by Senate Republicans. The filibuster reform will allow Harry Reid to finally push some of these appointments through the Senate. The right wing has turned the judicial system into a conservative policy making establishment.
The real headline of this story should have read, “Hack Right Wing Judicial Activists Rule Obama Violated the Constitution,” but the truth rarely makes for a sexy headline. Instead, the media has chosen to maintain their ignorance under the disguise of “objectivity.”
Instead of being a serious legal ruling this decision was yet another partisan attack on the legitimacy of Barack Obama’s presidency, but right wing judicial activism is a subject that the media refuses to discuss.

So is this a done deal or is it a ruling the White House can appeal? Are these recess appointments allowed to stay on, if they can appeal the ruling?

Yes it can be appealed to SCOTUS.My guess it will be overturned because the ruling threw out 150 years of Presidents powers to make recess appointments and the Judiciary dont really like getting into fights over separation of powers.
With all that said this is reason pick a number that elections have consequences.He who is President appoints Federal judges and the republicans have understood this since Reagan.Stack the courts with people who believes in your cause even without the power in the other 2 branches you can still effect the discourse.And they are there for life.
Again thank you Harry Reid without filibuster reform they can block all appointments that needs advise and consent.

The usual next step for the Justice Department would be to go for an en banc (full court) rehearing, because this case went before a three-judge panel, and this is their decision.

Hi Matt,
Yes, this is not CONTROLLING law—there are levels of appeals above, but the standard of review upon appeal is different. Appeals win on one of two grounds: 1. The Judge below made a mistake of law or 2. The Judge below exceeded their authority.
In this instance, I think # 1 is where the appeal has best chance of success. Two requires that the court be acting without or in excesss of its jurisdiction.
It is way off the norm as a decision and will likely be overturned upon appeal, but it has the negative effect of leaving matters in limbo while it is reviewed by a higher court—and it spends taxpayer monies which should not have had to be spent this way.

No one actually believes that Obama is a communist except those people who hang on every word that comes off of Fox News, and the people who pull their strings there. “Communist” is just a buzz word that triggers fear in the hearts and minds of those old enough to have lived through the Cold War and the time just before and after it. It’s like screaming bomb in an airport. This is why that particularly claim cannot be defended. It’s a buzz word, and the negative connotation is what the real goal is. The GOP leadership is taking advantage of the fears of their audience to keep them in the herd, that’s all. Your request simply cannot be met because there is no basis in reality for it.
Communism was not about equal opportunity, even at it’s start. It was supposedly about equality in benefit, not opportunity. Obama speaks of equal opportunity, take those opportunities or don’t, but at least you have them. This ridiculous notion of Obama being a Marxist or a Communist simply cannot be defended.

I’m a supporter of the president and I am not a Communist or drooling. I certainly see the president as farther right than many on the left want to see him. I’m definitely not a “brainless minion” and I see the division the country has but I think it comes from the hateful and hate filled rhetoric of those the right seems to worship- like Limbaugh, Beck and all the rest of the hot air that comes from places like Faux News. Thank heavens at least Palin no longer has a paid spot on their airwaves. Tired of hearing from her and even her name. She proved to be one of the nastiest in 2008. It seems too many on the right aren’t interested in actual facts just like the Romney campaign proved during the election season when they said they weren’t going to bother with fact checking. So if untruths and hatefulness comes from the right- who is it that is dividing the country?

In 1940, there was a big problem with the German-American Nazi Bund. It was marching the streets armed, and plotting a “Revolution”. The Smith Act was passed to deal with this issue, and to make a single law to cover this, instead of the previous hodge-podge of laws that were ineffectively dealing with the problem since WW1 (Anarcho-syndicalists, etc).
Then, in the late 1940′s, it was revealed that the Communist Party of the USA was also plotting an armed “Revolution”. The Smitch Act was used again, quite effectively. Interestingly, the Commies used a LOT of the same arguments and quotations that the current problem does.
Now, the Teagaggers are openly plotting an armed “Revolution”.

Knowing the fact that Barack has been hesitant to use executive privelidges time after time James and other low IQ folks never research how many times fewer this president has used them, especially with a case overload on the courts and not enough judges. They wanted to block him in the hopes that Mitt would win and stack the courts with Scalias and wing nuts like Sentelle. My biggest worry when this goes to the supreme idiots is we know how 8 will vote, the last one Roberts is worrysome, by that I mean he might vote against Obama because of the flack he caught over the PPACA. If that happens, then we might need our guns LOL.

Jason it was great of you to bring this information to our attention. It’s very sad that the main stream media refuses to inform the public but would much rather sensationalize GOP talking points for ratings. They’ve done a serious injustice to the American people. And they continue to do so. Just like after a brilliant and historic second inauguration for President Obama, the media focuses on whether Beyonce sang live or not and the supreme importance of that. I sincerely hope this decision is overturned because this one particular appointment was for consumer protection. The GOP has been obstructing so much, I’m shocked that President Obama has succeeded in getting things accomplished that he has so far. The POTUS has had hell for the last 4 years trying to get appointments through the Senate that are really necessary for America to be governed safely. The professional left needs to do their jobs in research and informing instead of complaining about Obama and the democratic party needs to provide the POTUS with the support he needs through their voices to continue to get important policies done. The DOJ needs a lot more support. Hopefully more justice appointments can get through. The GOP party of NO must become the party with NO power before they ruin our long painful fight for democracy for all. We must continue the fight for justice and fairness in America. The point that will be missed here is that no matter what level that a Black man obtains in this nation the judicial system actions remains the same. Some will say that this is not a racial thing but that is all it is. Only thing I have to say is that this action against the POTUS has not occurred in 150 years speaks volume toward racism in every way. Now it has to be appealed to those right winged nuts at the SCOTUS…
