Debunking The GOP’s Power Grab Meme: Obama’s Made Only 29 Recess Appointments

The Republican Party is crying power grab, but even with the recess appointment of Richard Cordray, Obama has made fewer recess appointments than Reagan, Clinton, and both Bushes.
According to the Congressional Research Service, “President William J. Clinton made 139 recess appointments, 95 to full-time positions. President George W. Bush made 171 recess appointments, of which 99 were to full-time positions. As of December 8, 2011, President Barack Obama had made 28 recess appointments, all to full-time positions.” Before Clinton, George H.W. Bush made 77 recess appointments, and Ronald Reagan made 240.
Ronald Reagan averaged more recess appointments in a year (30) than Barack Obama has made during his entire presidency. Yet, Republicans have deemed Obama’s most recent appoint of Richard Cordray to head the CFPB an unconstitutional power grab. Republicans are threatening to take the matter to court, but they are unlikely to be successful.
In 2004, Democrats unsuccessfully tried to challenge the constitutionality of George W. Bush’s recess appointment of Judge William Pryor. The GOP congressional leadership is reportedly outraged that Obama would use a recess appointment to get around there obstruction, but interestingly many of these same Republicans who are outraged today were defending the constitutionality of George W. Bush’s recess appointment of Pryor. (Democrats hold the same shifting positions on recess appointments, which indicate that this is more about political bluster than constitutionality).
The Republican meme that Obama’s appointment of Cordray is an unprecedented executive power grab is completely false. All presidents dating back to George Washington have used recess appointments, so there is nothing unusual about what Obama has done. In the face of another defeat, Republicans are foolishly retreating back to their narrative that Obama is a political strongman who does not respect the constitution.
This story plays well with the right wing base of the GOP, but the rest of the country shouldn’t buy it. What most of the nation has witnesses over the first two and half years of Obama’s term has been a president who has been very cautious with the use of his executive powers. Much to the dismay of many on the left, Obama had tried to govern as consensus builder instead of a Bush/Nixon imperial president. After the Republicans repeatedly demonstrated that have no interest in consensus, Obama started to exercise his constitutionally granted executive powers.
This is another public relations battle that the GOP is destined to lose. By challenging Obama’s recess appointment of someone to head the bureau that will protect the American people from the same shoddy financial products that helped to crash the American economy, Republicans are reinforcing Obama’s message that they are the party of only the rich. Obama has managed to use this appointment to further his message that he is the champion of the middle class.
With their only strategy to stop Obama going up in smoke, Republicans are left with nothing but power grab fairy tales and empty talking points that distort and deny their own party’s political history.

Well in this case the GOP is nuts. as noted historically but they are right about one thing. Obama does NOT care about or respect the constitution (any more than republicans do)
Most of the major laws he has passed are flat out blatantly unconstitutional.
Yet he passes them anyway. I for one find this even more distasteful than Bush’s blatant disregard for the constitution simply because Obama was supposed to have been a Constitutional Scholar. He should know better above anyone else.

Its unbelievable. They complain about Dem methods of passing bills yet did the same themselves to get Bush’s middle class, job killing tax cuts passed. They supported Herr Busler and his doing recess appointments and yet cry about Obama doing it.
Write your republican reps, tell them you are not hillbillys and rednecks and you know the word hypocrisy applies to them. Boehner is at best an idiot

I think Shiva is confusing passing legislation with agency appointments. Only Congress can pass bills. Bush nor Clinton nor Obama ever “passed” any bills. And, Congress is supposed to have oversight on appointments–when it’s in session, which it was, unless they’re in recess, which it wasn’t.

I’ve heard and read that FNB doesn’t give the facts, or lies, but so far I’ve never seen hard, cold printed proof of a lie that Fox has aired.
We need to remember that opinion and invective are not facts, nor is name-calling. To publish facts with which we disagrees is not the same as lying. Nor is railing a proof of another’s lying.
As a regular FOX viewer, I’ll guarantee that if anyone can document a lie put out by Fox News REPORTERS, it will be researched and corrected if proven to be untrue. Now, this doesn’t necessarily go for the news ANALYSISTS or EDITORALS. They sometimes shoot from the hip, just as do MSNBC, NBC, ABC, and CBS, not to mention PBS. Even Beck, when he was on FOX, was often called a liar, but never, ever proven to be so. Accusations are easy to come by, proof is often much harder to corral.
I’d be very interested to see DOCUMENTED proof of lies promulgated by FOX.

Oh my. All along I thought this thread was a discussion of the constitutionality of Obama’s alleged recess appointment. Turns out it’s an entrance exam for heaven. Who knew.
Greek history has the story of Diogenes the philosopher going about with a lantern, looking for an honest man. I can identify–with the “old” and with the futility of search. I keep going from one of these sites to another, looking for a group who can just discuss, agree to disagree, and remain civil. What I keep finding are arguments devoid of facts, juvenile name calling somehow mistaken for intelligent debate and insults that pass for rebuttal.
Why do people continually, under the cover of anonymity, insist on personal attacks and insults. You don’t know me, nor I you. Any disagreement I have is with your reasoning and the arguments you make. I gain nothing by insulting you. That has nothing whatsoever to do with refuting or challenging your remarks. I dare say your demeanor would be quite different if you were my guest on a Sunday afternoon and we were talking in easy chairs on my front porch. Why not that same consideration here? In the parlance of the day, chill out and let’s just talk.
