Obamacare Lives!!!! Supreme Court Upholds Affordable Care Act
A shocker from the Supreme Court as the conservative court has upheld the Affordable Care Act. The individual mandate which has been railed against by Republicans for two years as constitutional.
To say that this is a surprise is an understatement. Almost all conventional wisdom thought that the individual mandate was dead. Needless to say, this is a huge victory for President Obama, and giant step in progress towards a universal healthcare system. The Court found that the individual mandate was not constitutional under the Commerce Clause, but is constitutional under the federal government’s taxation power. The Supreme Court found the middle by limiting the Commerce Clause, but determined that the mandate was a penalty that is constitutional.
The dissenters were Scalia, Thomas, Kennedy, and Alito. George W. Bush appointee and Chief Justice John Roberts sided with the liberals on the court and wrote the majority decision.
The individual mandate was saved as, “CHIEF JUSTICE ROBERTS concluded in Part III-B that the individual mandate must be construed as imposing a tax on those who do not have health insurance, if such a construction is reasonable.”
The majority of the court reasoned that, “The Affordable Care Act does not require that the penalty for failing to comply with the individual mandate be treated as a tax for purposes of the Anti-Injunction Act.The Anti-Injunction Act therefore does not apply to this suit, and we may proceed to the merits.”

I am surprised at Kennedy. I am shocked at Roberts. Not sure how the dissenters could dissent because of the law. But this will help the Scalia Resign movement.
As someone with a pre-existing condition I applaud this decision. I do not heighten my opinion of the court

I think he finally got worried about his legacy. The poll numbers and commentary on the court have become more and more accusatory. The status of the court has been sinking. He has previously made comments that is cares about the legacy of his court.

For me, a huge sense of relief. This means that once I loose the coverage I have (which will probably happen as I start classes), the problems I do have will not loose coverage.
Maybe there is some hope after all for this country.

A huge sense of relief for me as well. My son was born premature, and he has a diagnosis of “chronic lung disease” attached to his medical record because he was hooked up to a respirator for so long. If “Obamacare” was overturned, we would have lost his coverage. I am making more money this year, and we would not be eligible for CHIP OR Medicaid. Yes, a huge, huge sense of relief.

Weve been told by a right wing lose machine that this was pretty much a done deal. They are trying to do the same thing with the President. They are reporting that Obama is desperate. A loser. Out of touch. Losing money. Pounding it into our heads (yes OUR heads). Breaking our spirit one unkind lie after another. Day after day like some kind of self full filing profecy. In this case it didn’t work. I suspect with the President it isn’t going to work either. No matter how bad they say Obamas numbers are, they never compare Romneys at the same time. Why? Because they are consistently WORSE than the Presidents! Resist their propoganda. We all were duped into believing there was no way the ACA was going to pass constitutional muster. That should scare us that this is such a surprise.

I totally count on and appreciate PoliticUSUSA’s daily news. They keep me informed. I trust their information. It’s just too bad you can’t get RW constituents to read your newsblog. They might realize how much the GOP has used them to win an election. I was at the gym watching the decision on 6 different TVs at the front of the room. They all had messed up intel – it passed, it didn’t pass, the vote was 6-3, no wait, 5-4. My question is, since existing Medicaid funds cannot be withheld from states who do not want to institute the program…..can states just not get on board and keep the status quo? (Myself, it affects me not at all, I’m from Massachusetts – although the bit about pre-existing conditions was welcome.)

Not me!!
I don’t want to be anywhere near being remotely healthy or have any access to straight teeth. I would prefer to be dicked around by poor health coverage and be at the total mercy of wealthy insurance companies who wish to jack costs by 10-25% every year. Further, it is my natural, God-given, patriotic American right to develop an unfortunate pre-existing condition and to not be able to get ANY health coverage for the rest of my sad, pathetic existence.
But God damn it, that’s what being MURCAN is all about! Freedom! I want to protect my precious freedom to die from lack of access to health care! I want to protect my freedom to a protracted, whizzing cough! I want to protect my freedom to be obese! I want to protect my to live with a heart murmur and not get any treatment while protecting my freedom to let Dick Cheney get all the heart ailment treatments he wants! I want to protect my freedom to tell dumb ass women what kind of health care they should have.
Most importantly, I want to protect my freedom to not be ruled the the tyranny of government health care–keep your damn governemnt hands off my medicare! I want the freedom to tell government death panels to fuck off because I’d rather have my life and death decisions made for me by stressed out insurance claims adjustors working for greedy health care companies.
I want to protect my freedom to the America I know and love–the land of the sick and the home of the flayed!

As an uninsured lower income Latino. This is horrible as bomb a trash was sold as not being a tax they argued it was a tax. Obama is a Marxist liar manipulating people and the system. Bomb a trash is water with cyanide that the wise will not drink. Many people are so gullible.. wrap evil in a pretty wrapper say it’s free and the unlearned rejoice.
