Woman Arrested for Speaking At City Council Meeting in Arizona
So you thought you had the right to free speech, huh? Not in Quartzsite, Arizona you don’t. Citizen Jennifer Jones, attempting to air the City Council’s dirty laundry, got arrested for speaking at a public meeting in Quartzsite, Arizona. Police arrested her for speaking at the order of the City Council, specifically Councilman Joe Winslow, even after the Mayor defended her right to speak. Police chief Jeff Gilbert arrested Mrs Jones over Mayor Ed Foster’s objections.
Mrs Jones was exercising her right as a citizen to speak at a City Council meeting, and she had the floor. Councilman Winslow shut her down by passing a motion to have her shut down, which in and of itself is a violation as motions can’t be passed while a recognized speaker has the floor.
Quartzsite, AZ – The Mayor is challenged under a recall election beginning next month. Accusations have been made. The city council is persecuting the Mayor for giving the people a voice. The Chief of Police is also involved in the scandal.
Jennifer Jones is given the floor at a city council meeting open to the public. While she is speaking the council realizes she’s about to air their dirty laundry and quickly beckons their henchman to cart her off.
The Mayor steps in and says Jones has been recognized to speak and has not violated the council’s rules, but the council ignores him and has the woman removed even as the Mayor continues to contest. The police officers ignore the Mayor of the city and remove the woman. It’s obvious who those cops work for, and it’s not the people.
Watch Mrs Jones calmly and with authority attempt to call the City Council out on their dirty laundry, and get arrested for it:
Mrs Jennifer Jones, resident thanks Council Member Anderson for reading the rules that the Town has in place on the agendas for public comment. Mrs Jones continues to speak about those rules. Council Member Winslow calls for “points of order”. Mrs, Jones continues. Council Member Winslow motioned that this (inaudible) be removed for the duration of the meeting. No audible second. Council Member Winslow calls for the vote. Vote is inaudible. Mayor Foster states that this lady has the floor, she has been recognized and has the floor. Council Member Winslow states the Council has passed the motioned Council Member Winslow advises Mrs Jones to leave or be escorted out. Confusion and chaos erupts. Shouting and hollering regarding the motion that was made by Council Member Winslow. Town Attorney Walsma states that there was a motion, a second and there was a vote, Mayor Foster states motions can’t be made during a Call to the Public; it is not on the agenda. Town Attorney Walsma states that the Council does have that right statutorily, Shouting and hollering continue. Significant disruption erupts.
This is still America and arresting citizens for speaking at a City Council meeting violates the spirit of the Open Meeting laws, in addition to being a chilling and inappropriate abuse of power. Is this what democracy looks like?

I’ll say it again. Arizona has always seemed like a lawless state. If I remember correctly, Quartzsite is basically a tent city. All the standing structures are mobile homes or double wides. I was ALWAYS grateful that in my travels I NEVER had to stop in Quartzsite. I always held my breath and obeyed every speed law whenever I had to pass through.
The only towns I ever visited that seemed ‘mainstream’ were Flagstaff and Prescott.

Dream/hope on. Won’t happen. This is standard M.O. for shutting down free speech. Send the police in to illegally detain/arrest people.
Obviously, someone willing to speak up is going to take it all the way to court and file some sort of lawsuit, so the police drop all charges after the fact. Courts will then rule that, since the charges were dropped, the victim has no standing to sue.
Obviously not right, at all, but that’s the way it always seems to play out.

George W Bush was paying Blackwater to train for
civil action in the country. They were authorized to use force and to kill when there was a threat of violence. They were training in Lynchburg, VA.
The police need to be held accountable and each officer needs to be at risk of losing their job when they violate the rights of others. If they do physical harm, they need to be personally reasonable. You will see cop kills and violence go down fast.

In that case she should then sue the police dept. separately for false arrest, false imprisonment, and throw in an action against Winslow for defamation, unlawful interference with protected speech, and do it all through the civil process, seeking only monetary damages. Then, since the actions did take place, with public witnesses, she can maintain standing in a tort action. HAH! there is always a way around if you think creatively. Also, I would move for a change in venue at the beginning, so she can avoid judicial bias and/or prejudice. I realize that to say that judges can demonstrate pre-judgment on a given case sounds strange to some, but even in America judges can be corrupt. Just look at SCOTUS.

I hate to say this started with the passing of the Patriot Act. I did 20 years in the military and was appalled that the so called Patriot Act was pushed down our throats and knew once passed, would hang on indefinately. Of course Bush also promised to prosecute the leak of the CIA agents name and then pardoned Scooter Libby instead. You get what you vote for :-(

No, you DO get what you vote for. If we keep voting in people who are under the thumb of big business, then yes, that is what you will get. We still have power…all those people in that gallery sitting on their collective asses and doing nothing to support either the resident OR the council – people sitting on their collective asses “watching a play”…they’re the ones that could take control but don’t. Too many of us sit back and watch, instead of asserting ourselves. They could have stood with that women, OR with the council, if that was their choice. But what did they do? Sit there! Too many “sheeple” and not enough people willing to stand up for, and face consequences for, their beliefs.

I agree with you Allyson- although sometimes the vote is corrupt, or there is NO public vote-but if those people-in the audience- the PUBLIC -had stood by this woman, as the Mayor had attempted to do, those cops would have backed off. You see them back off the first time, because they feel the support of the room shift against them. When it swings back around, they go for it. Chicken sh*t. They would NOT have done it if citizens had physically stood by her. We all need to realize our rights, and to be braver!

The best part about that argument is, is the police had to clear the room and arrest every member of the public who defied them, their jails/courts would be overrun with cases! This they would try very hard to avoid, as it would lead to a mulitiplicity of lawsuits.

AMEN to that! Here in Baltimore (affectionately known as “Murdermore” by its residents), the “Stop Snitching” thing is in full effect, and terrifies the sheeple here. No one stands up, no one speaks out, nothing changes, people continue to bitch and pray for it to get better somehow, and it never does.
People AND sheeple need to realize and embrace the notion that “Evil flourishes when good men stand by and do nothing”.

Gene O, sadly we don’t necessarily “get what we vote for.” In spite of all the moronic candidates they rarely really win elections- but they often get announced and confirmed as winners by a few people who supervise the vote counts. The voting machines most people use are easy to screw around with, and vote flipping, shaving and dropping is very normal in many places.
For some reason, even when presented with irrefutable statistical and forensic proof, the Justice Department refuses to look into it -publicly at least, and mainstream media refuses to investigate and report.
Obama won by over a 20 million vote margin, not 9 million… and was denied the Landslide he and Dems won. GW Bush never won an election outside of Texas, if there. Scott Walker of Wisconsin didn’t really win. Kasich of Ohio didn’t really win.

Just wanted to say that I’m pretty sure that technically those officers can lose their badges for failing to follow a direct order of an executive member of a city government (eg. the Mayor). Disobeying city elected leadership (for instance, the Sheriff in some municipalities) is typically grounds for summary dismissal (without pension or compensation packages). The Mayor should be hounded to issue pink slips to these officers… and see that the city hires officers that will obey his/her orders in the future, or lawful orders issued by law, through proper council proceedings…

Fun fact Julie: Arizona’s a red state, most if not all of their popular/in-power govenment officials are Republican. Heck John McCain is their most well-known Senator. There’s no real standing reason to pin this on Democrats. Granted, blaming the strong-arming on Republicans is kind of generalizing things without proof, especially in the case of the Mayor of Quartzsite where he didn’t seem to care about party lines in the face of First Amendment rights being violate, major kudos to him, but this clearly isn’t a case where Democrats are the ones bending the police to their will. Nice try hiding behind the “OH NO SOCIALISM!” defense, though.

Here in Michigan, there is an Emergency Financial Planner law in effect that allows our Governor/Czar to declare any city or town financially dependent, appoint an EFP at $100,000 a year, and said person will come into the town, dismantle the elected officials, including police, school boards, and the Mayor, and totally take over the town. He can dissolve the school system and merge it with another. He can sell off assets to pay debt…all this with NO VOTE of the people. This is why we are trying to impeach Snyder and get him out, among other things. He is also demonizing our teachers and public employees, while coddling business. It is a terrifying time in America.

In Ohio we have a Governor that is doing things that even some of the people who voted for him disagree upon…and we are at least attempting to do something about it legislatively. We have some of the same problems here in PA and no recall ability. H’es a governor only in 7 months. He’s an extreme right who just passed a budget crippling our education funds while refusing to tax a major business amongst other things. How do we stop them if there is no recall? Does anyone have a clue?

Our K-12 education beats the crap out of the US, our health care [socialized, of course] affords a longer life, better health, less obesity, lower infant death rates, less cost, equal treatment for all, and we have less poverty, less income disparity, lower unemployment, far less violent crime, far fewer criminals, far lower costs for imprisoning our citizens, more highly developed technology/development, a highly favorable trade balance with the US, and on, and on, and on .. ..
Indeed it is a dangerous/terrifying time in the US.

Mr Shreiner, you are absolutely correct. However, what you and everyone else here doesn’t realize is, our problems stem from two groups of people in this country: lawyers and the religious.
USA has 6-8% of the world’s population and more than 65% of the world’s lawyers. Lawyers make money by creating a divided society and ours have been grossly successful because Americans are deathly afraid of losing their ‘stuff’ and so the ones that could make a difference, cower at home and yell at the TV, or worse, watch Fox News.
Lawyers have usurped our government and changed this country from one of common law to one of rule of law, meaning they can change pretty much anything they want, any time they want, without consulting Americans, because despite what most Americans think, we do NOT live in a democracy, instead we are slaves under a Republic representative government.
Until we rid our country of the lawyers, we will remain powerless. Until there is real reform of our system of law and a return to common law, no advancements can be made in this country.
The Bard was correct when he said, through one of his plays…”The first thing we do is, kill all the lawyers.”
Second, is reestablish the strict “…seperation of church and state…” that the Constitution calls for. The radical right, represented in this country by the Evangelicals, have inundated themselves into our government and more scarily, our military. Their bastion of hope, that insane caricature of a person Michelle Bachmann, has publically said our Founding Fathers meant for this country to be a Theocracy. They ignore facts of any sort to push their insanity on all of America.
In 1995 there were NO evangelical chaplains in the military of the United States; today they represent over 95% of all Chaplains. The first rule for establishment of a Theocracy is to control the military.
Troops returning from the Middle East are being told by an ever-increasing number of evangelical Officers (promotions and assignments are now basically controlled by being or not being evangelical in the officer corps of the Army) that they are returning to the US after a great crusade against the ungodly heathen muslims.
Our Founding Fathers, in many communications, speeches and letters to acquaintances and friends, had reiterated how dangerous religion would be to a democracy, coming right out and saying Christianity is the single greatest threat to democracy in this country and calling Christianity the single bloodiest religion on the planet.
Socialized medicine won’t ever happen here because of the tremendous amount of cash, fraud and abuse perpetrated upon the current system by the doctors and corporations who make their money off it.
BTW, I’m running for President. I stand no chance, of course, because I don’t have the support of corporations, but I have to at least make an effort.
I urge everyone to reread the Declaration of Independence and come to understand the power that the people in this country have.

While I agree with you on the lawyers, please know that a ‘strict separation of church and state’ does not exist in the constitution. Those words are not there.(they stem from a letter from Jefferson and have been referenced by the Supreme court in some decisions, but the ‘wall of separation’ that Jefferson references was in regard to the establishment of an official religion, and not an attempt to limit the free speech of anyone.) And just as you rail against the slander of the Muslims, you slander the Christians in the same breath, (or you seek to defend their right to religion while railing against Christianity) Freedom of religion requires that we tolerate religious speech in all areas of life, including government sometimes. To do otherwise would be a violation of the first amendment. to enact laws because they are ‘Godly’ is also wrong. Lawyers and religion cause a lot of problems in the world, especially in the united states. Be careful not to nullify your point by defending Muslims while putting down the actions of some Christians. I think some simple illustrations can be made to show the folly of both Islam and Christianity as dangerous forces in politics.

Now now now. It’s perfectly reasonable to criticize the *political* activities of any group, any time. You don’t get a free pass for being part of a Muslim OR a Christian OR a Jewish OR a Reformed Druid group. Not if you wish to put candidates on the school board and city council on the strength of your “faith.”
I put “faith” in quotes, because if your religion cannot survive without legally compelled indoctrination and enforced “respect” for your “faith,” it’s not actual faith.

city and Township meetings are the very base of our government. You will find in many cases that the Township you live in has more authority than the state that you live in. But what happened here goes well beyond any city or township meeting protocols. This was very laughable is that these counsel people were in such a panic to keep this lady from speaking. But then again let’s look at how many people were at the council meeting. At quick glance it seemed like it was a small group of people and as long as you have that kind of attendance a city Council can do whatever it wants in almost complete notoriety. It is left up to those few citizens who the other people at that meeting to spread the word. Maybe it would behoove all of us to start attending city Council meetings.

No president has given up a power that was passed on to him. Just another tool in the tool box. If the economy completely crashes and we end up like Greece, rest assured this president will use every power in that Patriot act he can to control the unrest that will come. Freedom and liberty have not been the concern of either major political party in decades. In this instance we see how, apparently, a corrupt local government can squash the civil rights of its citizenry. Wal Mart, Monsanto and the Dems or Repubs are not to blame here. Bearing witness to this injustice will hopefully right this wrong.

The American Civil Liberties Union will love this one. I hope they kick their *** (with the exception of the mayor). The law enforcement were put in a bad position with conflicting directives from their superiors.
When I read about incidents like this, I have to remind myself that this is the USA and the year is 2011–it is so incredible.
I remember back in the 60s at the Democratic National Convention, a racially mixed delegation from Georgia challenged the seating of the all-white delegation. They tried to speak, but the microphone was suddenly shut off.
Every day our freedoms are threatened, oft times in small ways, but threatening nonetheless, and those threats must be countered–every day.

No government can regulate itself. However, once a government becomes an entity, it virtually becomes a self-sustaining one and unless controlled, becomes a beast that we soon find uncontrollable. Visit city council meetings, attend political debates, become involved in at least one facet of our governmental process and invite others to join you.

That happened here in Florida in the City of Alachua, where Charlie Grapski was arrested for speaking at the City Council meeting!

The story has a tragic ending. Although Grapski is a scholar and never did anything illegal, because the Alachua County justice system is so corrupt (a bunch of good ol’ boys) he was jailed, and was horribly injured and effectively tortured in jail, and has been falsely accused and repeatedly arrested. He’s suffering from severe PTSD, is impoverished, and unable to find employment because of his entirely unjustified “criminal record” and health problems arising from his treatment in jail.
