The Obama administration announced Tuesday it plans to file an appeal to the Supreme Court of a ruling that blocks the president’s executive actions on immigration.

The decision comes less than one day after the 5th Circuit Court of Appeals decided to keep an injunction in place that has prevented the programs from taking effect.

“The department disagrees with the Fifth Circuit’s adverse ruling and intends to seek further review from the Supreme Court of the United States,” Department of Justice spokesman Patrick Rodenbush said in a statement.

Sen. Bernie Sanders (I-VT) rallied the liberal troops in immediate support of the President’s decision.

Sanders said, “The president is absolutely right to appeal this unfortunate lower-court decision. American immigration policy should be about uniting families, not separating families. President Obama believes that the parents of children who are citizens or legal permanent residents should be able to stay with their children, not be forced out of the country. I look forward to the Supreme Court acknowledging the president’s position.”

If Bernie Sanders seemed confident that is because he should be. The conservative lower courts have been practicing judicial activism by blocking the President’s executive orders on some dubious grounds. The Roberts court should be receptive to the administration’s argument.

The High Court will never admit it, but public pressure and the winds of popular opinion do seem to matter to the court. Liberals and all supporters of immigration reform across the political spectrum need to make their voices heard in support of the President’s executive actions.

The vast majority of the country supports immigration reform and it is time for the will of the majority to be carried out.
