When President Trump asked the then FBI Director to drop the Flynn investigation, Flynn was in legal jeopardy and was under FBI criminal investigation.
During his testimony to the Senate Intel panel Thursday, former FBI Director James Comey said, “General Flynn at that time was in legal jeopardy. There was an open FBI criminal investigation of his statements in connection with the Russian contacts and the contacts themselves.”

Sen. Burr (R-NC) asked, “In your estimation at that time, was Gen Flynn at that time in serious legal jeopardy. And in addition to that do you sense the President was trying to obstruct justice or just seek for a way for Mike Flynn to save face given that he had already been fired.”
Comey replied, “General Flynn at that time was in legal jeopardy. There was an open FBI criminal investigation of his statements in connection with the Russian contacts and the contacts themselves. That was my assessment at the time.”
Comey refused to draw conclusions based on the facts (which is not his job) but related the facts that he was disturbed by it, “I don’t think it’s for me to say whether the conversation I had with the President was an effort to obstruct; I took it as a very disturbing thing, very concerning, but that’s a conclusion I’m sure the special counsel will work towards to try and work towards, to understand what the intention was there and whether that’s an offense.”
President Trump asked the then FBI Director to drop an investigation into Trump’s by then fired National Security Adviser for criminal activity. Flynn was in legal jeopardy when Trump pressured Comey to let the investigation go.
