The White House legal strategy to justify declaring a national emergency for the wall is to get their talking to say national emergency a whole lot.
This is the Trump legal strategy:
Liptak also reports that the lawyers are "looking for other ways to illustrate that an emergency is underway, recognizing a declaration would be challenged by Democrats. That has included hosting lawmakers in the Situation Room, a setting that lends to the sense of crisis."

As Mimi Rocah pointed out, this strategy has already failed in other areas where Trump has tried it:
This won’t work in a court of law. (Just like in the criminal arena where they been repeatedly shot down by judges with this kind of gamesmanship). https://t.co/KP2keH0f11

Saying crisis isn’t like the movie Beetlejuice. The White House can’t say crisis three times a border crisis appears.
The problem with the Trump gang is that they are not equipped to do any legal or strategic thinking. They are constantly playing politics and catering to their Fox News crowd. The legal standard for a national emergency is much higher than arguing in court that it is an emergency because the president says so.
It is a desperate ploy by a desperate president that will be shot down by any respectable court.
