Trump thinks that he gets to decide whether the House Ways and Means Committee gets to see his tax returns, but the law states that it isn’t up to Trump.

Trump said when asked about turning over his tax returns to Congress, “We’re under audit, despite what people said, until such time as I’m not under audit, I would not be inclined to do that.”

As Rep. Dan Kildee (D-MI) explained as long as Congress has made a legally valid request, the IRS must comply and turn over the returns, “It’s not up to the Treasury Secretary. It’s up to the commissioner of the IRS. That’s who the letter was addressed to. When Secretary Mnuchin was before the committee, he said the same thing. The commissioner of the IRS will follow the law. That’s our expectation that he will follow the law of the United States and deliver the returns that had been requested.”
According to Sec. 6103 of the tax code, the chairman of Ways and Means committee can call for tax returns and the IRS has to turn them over.
It is not up to Trump, or his audit excuse, which is bogus. Am audit does not stop Trump from turning over his tax returns. There is nothing stopping Trump from making his tax returns public today. Democrats have smartly picked this battle, and if Trump wants a fight, he is going to get one.
As Ways and Means Committee member Rep. Bill Pascrell said:
The White House can try to fight this request, but they will lose. Congress is going to get Trump’s tax returns. It’s only a matter of time.
