The Trump administration has issued a formal veto threat related to the congressional resolution that would kill his fake national emergency along the southern border.

Trump will veto the resolution killing his national emergency

Here is the Statement of Administration Policy:

The White House wrote:

The resolution would terminate the national emergency declared by the President on February 15, 2019, and undermine the Administration’s ability to respond effectively to the ongoing crisis at the Southern Border. The President’s emergency declaration, and his further determination that the emergency requires the use of the Armed Forces, allowed the President to invoke the construction authority provided in 10 U.S.C. 2808, and made that authority available to the Secretary of Defense, within his discretion, to undertake military construction projects that are necessary to support such use of the Armed Forces. This is the same authority that President George W. Bush and President Barack Obama used to undertake more than 18 different military construction projects between 2001 and 2013.

If H.J. Res. 46 were presented to the President in its current form, his advisors would recommend that he veto it.

Trump is reappropriating money for a non-congressionally intended use

The White House argument continues to leave out one key point. Trump is trying to move money that Congress already appropriated for a different purpose to pay for his wall. No president has ever tried to take the power of the purse away from Congress. Trump is violating of the Constitution. The other presidents did it argument doesn’t hold up, because other presidents didn’t try to steal money that Congress had appropriated for a different purpose.

Image if Obama had taken DOD and disaster relief funds and tried to spend it on an expansion of healthcare. Republicans would have been outraged. Impeachment proceedings may have been launched, but Trump tries to violate the Constitution to get his wall, and Republicans shrug it off.

Speaker Pelosi recently said that the resolution is about more than a wall. It’s about the Constitution and standing up for democracy.

Republicans must stare down Trump’s veto threat, stand up for democracy, and put an end to this national emergency con.
