    Sarah Palin, I believe, was acting in her official capacity as Governor when she waved the flag to start the Iron Dog race. Further, she was definitely acting in her official capacity during the interview with Fox “News” (Greta Van Susteren) where she addressed current Alaskan and national political topics. Her travel reimbursement forms have not been filed yet, but she has charged the State for her travel to the start of the Iron Dog before (in addition to charging for her children’s travel, although some of that will now be paid back). She was there as Governor.

    Whether or not Sarah was under contract to wear the clothing as part of Arctic Cat’s sponsorship deal is irrelevant. Her financial disclosure form reveals the significant financial benefit her family receives from Arctic Cat. Arctic Cat makes a big deal in their own literature that Todd Palin, spouse of Governor and Vice Presidential candidate Sarah Palin, uses their products. Sarah was pictured (and referred to as Governor Palin) in national media and on the State’s (not her personal) Web site wearing clothing with the bright, unmistakable logo.

    If you’ll read the complaint (you linked to Linda Kellen Biegel’s site and you can find a copy there), the law is quite clear that an executive branch official may not personally benefit from any of their actions.
