Bush War Crimes Defender Admits Obama Didn’t Break Law But Should be Impeached Anyway

Bush War Crimes defender, Michael Mukasey, is the latest to weigh in on Bowe Bergandahl and the Republican/Tea Party’s endless pursuit of a reason to impeach the president.

Mukasey admits that President Obama didn’t violate the law when he secured Bergendahl’s release, but he should be impeached anyway.  Unlike Congressional Republicans, Mukasey doesn’t believe that Obama violated the 30 day notice law, though under Mukasey logic it’s because that law is unconstitutional.  Still, he wants Obama to be impeached because he, Mukasey, has serious questions about this president’s prisoner swap, notwithstanding the Gitmo prisoner releases that occurred on his watch.

Mukasey became unleashed from what we all ought to hope are his constitutional moorings.  Our Constitution is very clear:  it takes “Treason, Bribery, or other high Crimes and Misdemeanors”   to remove the President and other government officials from office.  That’s it.  But Mukasey has other ideas.

To his credit, Mukasey admits the 30-day notice requirement is unconstitutional.  Never mind that even if it were constitutional, failure to give notice has no criminal penalty attached to it.  NDAA Sec. 1035(d).   Not to be deterred, Mukasey makes up his own rule:  that there be “serious questions about whether he should continue in office.”  ”Serious questions,” he says.  Really?  So we’re to abandon a solid place in constitutional law and rush head-long into the vast, nebulous, indeterminate, even arbitrary puddle of “should?”

Not only does the “should” standard fall short of what the Founders gave us, but it goes in a bad direction:  a President can be removed if Congress merely thinks he messed up.  That’s a political standard or at least a policy-oriented standard, not a criminal one.  The Constitution and its very principles of checks and balances and separation of powers simply do not let Congress throw out a President because they disagree with him.  No, Mr. Mukasey, not even if they have “serious questions.”

A fun side-note:  officers and judges at the International Criminal Court can be removed for “serious misconduct.” Rome Statute Art. 46(1)(a).

That’s a much lower standard than outright criminality.  Is Mukasey going all New World Order on us?

The one possibility we see is that Mukasey was thinking about some sort of declaration that Obama is unfit for office.  The problem there is that that means going a different route than impeachment.  Rather, “the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide.”

Of course, the Obama haters in Congress wouldn’t have it because this mechanism would deny them the sugar rush that comes with their inquisitions and it would mean they’d have to find another excuse to avoid doing their jobs.

The fact is Republicans just want to impeach the democratically elected President because he is both black and a Democrat. They’re willing to do whatever it takes as we’ve seen with their sham trials and lies.  Mukasey took Republican desperation to a whole new level of revisionism by making up his own rules and trying to sell them as the law.

Republicans were just as obsessed with impeachment during Bill Clinton’s administration.  Odds are they will be just as impeachment thirsty when likely Democratic candidate, Hillary Clinton, is elected in 2016.

The fact that Barack Obama is black is an additional thorn in the Tea controlled Republican Party’s side, a thorn that has caused them to create their own facts about everything from the President’s place of birth, to his policy initiatives and his actions as president.

As time goes by Barack Obama has bested the Republicans in every way imaginable, so it’s easy to see why they are so desperate they are even willing to entertain using icky international law to pave the way to impeachment.

Obama got Bin Laden where the Republicans failed.  The disastrous policies of the Bush administration left Obama with serious messes to clean up.  The economy was on life support. We were bleeding jobs.  Obama turned all of that around with the added challenge of Republican obstructionism. Then, of course, there are the war crimes that caused extensive damage to our ability to play the world’s moral authority and defender of human rights.

Michael Mukasey defended those war crimes.  So for him to even enter this discussion takes chutzpah. Making up laws and possible resorting to the ICC statute just shows how desperate he and Republicans are to find anything that will give them an impeachment sugar rush.

  1. They are making the term “Impeach” lose all meaning. This is the party that impeached Bill Clinton’s just for snickers and giggles. Seriously.

  2. Just think that the republican party would of had the first President impeached that would of been removed from office, if he hadn’t resigned. Nixon put the 2 party system in jeopardy when he gave the order for those thugs to break in the Democrat Headquarters.

  4. Perhaps Congress needs to be placed under the same rulings they suggest for the pres. If one thinks they did wrong they can be impeached. None of them would be in office today

  5. Impeach Obama he wore a blue suit today. Impeach Obama he played golf today. Impeach Obama he….., and so it goes on and on. If these bunch of losers worked as hard on trying to move this country forward as they do trying to impeach Obama we would be 10 times further ahead. They’re like a bunch of simpletons focused solely on the shiny object.

    I wish they would try to impeach him. The Dems would come out to vote then. I guess they didn’t learn their lesson with Bill. Idiots.

  6. Just to be clear, Michael Mukasey justified the war crime of waterboarding as well as the practice of rendition to third countries during his stint as AG in the Bush administration. His ignorance of settled law regarding war crimes as well as his failure to enforce the law when it was his sworn duty renders any utterance from him moot. One has to wonder why he would be considered a credible source with an opinion to be heard let alone followed.

  7. If the Republicans take over the Senate (gawd forbid) in November, I have a very bad feeling they WILL try to impeach President Obama. They won’t need a good reason, they’ll make something up.
    Vote, everyone. It really matters.

  8. If there was ever a President that should have been impeached, it was GW Bush, for war crimes. If you weren’t a party to pushing for his impeachment, then you’re delusional if you think anything President Obama has done is an impeachable offense.

  11. I agree impeach impeach impeach that’s all these buffoons can focus on. They all hate Democrats because he is showing stones and helping the little people, and by little people I mean middle class. It seems to me and I could be wrong it all really started when gun laws were mentioned. What these so-called Republicans are doing is cutting their feet off when they vote Republican.

  12. I agree: After determining that all Republicans are NOT ALL functional illiterates: and that many of them can actually read and write in the English language! It is safe to say that A: America is changing around them.
    B: They do not like the changes.
    C: Not that President Obama will go down in History as another Washington, T. Roosevelt, or Eisenhower, he will not go down as worse than Cal Coolidge, Herbert Hoover, and Milard Fillmore.
    D: The only thing left for their nearly total dislike for a man who is trying to help Americans, is out and out racism.

TEA-Republicans have nothing and scrape bottom by going impeachment.   14. there is a little matter of fast n furious that keeps being shoved under the rug.there is also the hearings in which ms.clinton pays such a prominent part.these issues come from his last term i felt that president obama might be impeached when i voted against his opponent.i am not surprised there should be talk now..i do agree that the last person to be in the oval office was a thousand times worse.i voted for president obama because i felt he would be better than any republican
    if he were impeached we would still have a democrat in office.,

  17. Every Republican who ever existed has screamed for the impeachment of any and every Democrat President who ever was President. The fact is, the Republican party just wants something to whine about. They want something to make an issue about. The game of politics is really the petty game of political sore looserism. Republicans have always been mudslingers. Funny thing about mud, you can either plant seeds in it or sling it. It’s odd how they prefer to sling it.

How many ignorant Birther thoughts are I their minds? At the drop of a hat, they call for IMPEACHMENT! He wins the ACA battle: They cry–IMPEACH! He saves the Auto industry: They cry–IMPEACH! He gets an American POW away from the clutches of the beheaders and gives the beheaders 5 old geezers I return: They want to —IMPEACH! He excercises careful diplomacy with the Russians on the Ukraine matter: They want to IMPEACH! On and on….Oh, and if he decides to dress casual on his day off in the Oval office, or put his foot up on the desk: The clucks want to IMPEACH him for that! WTF is WRONG with these people!!!!!!!!!!!!
